What does this regularization actually mean?
First things first: it''s not an "amnesty" or a gift. It''s an exceptional, regulated procedure with an expiry date, approved by Royal Decree 316/2026 of April 14, published in the BOE on April 15 and in force since April 16.
What this rule does is open a temporary window aimed exclusively at people who already live in Spain before January 1, 2026.
What you get if granted: a one-year residence and work permit, valid in any sector and across all of Spain. After that year, you must transition to ordinary Immigration Regulation pathways — arraigos, employment-based permits, etc. — to remain regular. It is, literally, a one-year springboard to organize your life.

Since the measure was announced, fake news has spread faster than serious information. These are the most dangerous ones — the kind that can cost you money with shady "advisors" already charging up to €400 to handle things incorrectly:

What do you need to apply?
The rule sets out two entry doors: one for international protection applicants (highly relevant for the Venezuelan community) and one for everyone else.
Common requirements (everyone must meet these)
- Be in Spain before January 1, 2026 — provable with any valid evidence: invoices, contracts, medical reports, remittances, padrón registration, bank statements, plane tickets…
- Prove uninterrupted stay of 5 months prior to the application. Note: uninterrupted means no exits from Spanish territory, not even short or justified ones.
- No criminal record in Spain, your country of origin or any country where you''ve lived in the last 5 years.
- Valid passport, registration card or travel document (expired passports accepted exceptionally).
- Application on official form, available at inclusion.gob.es/regularización.
If you''re not an asylum applicant, you must also prove ONE of these three (only one):
- Having worked as employee or self-employed in Spain, or proving intent to work with a job offer.
- Having minor children, adult children with disability, or first-degree ascendants in your care in Spain.
- Being in a situation of vulnerability, certified by a report issued by municipal social services or by RECEX organizations.
If you''re an international protection applicant (typical case for many Venezuelans and Colombians):
- Your asylum application must have been filed before January 1, 2026, whether pending, denied or under appeal.
- You don''t need to renounce asylum to apply for regularization. They are compatible.
- If you''ve been resident in Spain for more than 5 years, you don''t need to provide criminal records from third countries.
It''s estimated that roughly half of the projected half-million beneficiaries will be asylum applicants, many of them Venezuelans with denial decisions accumulated in recent years.

You can do it yourself with a digital certificate, or through lawyers, social workers, administrative agents or RECEX organizations — more than 150 organizations offer free assistance. In a single appointment, all family unit members are processed.
